These Terms of Service ("Terms") constitute a legally binding agreement between you and HomeUp ("Company," "we," "us," or "our") concerning your access to and use of our platform, mobile application, and services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Services.
You must be at least 18 years old and legally capable of entering into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.
To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without prior notice or liability.
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
Use the Services in any way that violates applicable laws or regulations
Provide false, inaccurate, or misleading information
Engage in fraudulent or deceptive practices
Interfere with or disrupt the Services or servers
Attempt to gain unauthorized access to any portion of the Services
Our financing services are subject to approval and additional terms. Not all applicants will qualify for financing. The terms of any loan or financing arrangement will be provided separately and are incorporated into these Terms by reference.
Participation in our flipper subscription programs and contractor partnerships is subject to separate agreements and compliance with our standards and guidelines. We reserve the right to modify or terminate these programs at any time.
The Services and their entire contents, features, and functionality are owned by HomeUp and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOMEUP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
You agree to indemnify, defend, and hold harmless HomeUp and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.
